Gardaí ordered to release Fusco documents

The High Court, sitting in Dublin, has ordered the state to produce all documentation on garda efforts to locate Angelo Fusco during the period between the Supreme Court's ordering of his extradition in February 1998 and his arrest on 3 January last. All communications between gardaí and the Minister for Justice in relation to that period must also be released, said Judge O'Neill.

Angelo Fusco spent years fighting extradition from the 26 Counties to prison in the Six Counties. He is currently being held in Castlerea Prison, County Roscommon, having been denied bail.

On Monday, 14 February, Senior Counsel Michael Forde, for Fusco, sought the documents to back Fusco's assertion that no serious attempts were made by gardaí to arrest and extradite him.

Fusco says that the gardaí kew well where he was but made no attempot to arrest him. In an affidavit, his wife, Mary Fusco, said Angelo had lived at their home in Tralee, County Kerry, and with a friend from the town since February 1998 and the gardaí had never called in that period looking for her husband.

Fusco's contention before the courts is that by its failure to enforce the extradition order within a month of the extradition order or to seek a renewal of the order within six months of the decision, the state had effectively given up any serious attempt to enforce the order.
